Freelancers & Independent Contractors! A new CA law could HURT your status!

If you’re a FREELANCER in CA (aka INDEPENDENT CONTRACTORS) — read all of this to protect your $$$ !

The Insurance Mom wants to make you aware of a recent CA Supreme Court ruling.    It could really HURT you as a FREELANCER.     If you HIRE freelancers, this new state law could hurt you as a business owner.   WATCH OUT!

Dynamex Operations West Inc. v. Superior Court (Dynamex) could require many 1099 independent contractors to become W-2 employeesand YOU won’t have a choice.

The ABC test determines WHO is an independent contractor or an employee.    You will be Independent Contractors ONLY if the hiring entity is able to PROVE ALL THREE of the following:

     (A)    That the worker is free from the control and direction of the hiring entity in connection with the performance of the work, both under the contract for the performance of the work and in fact;

     (B)    That the worker performs work that is outside the usual course of the hiring entity’s business; and,

     (C)    That the worker is customarily engaged in an independently established trade, occupation, or business of the same nature as the work performed.

You should be VERY alarmed!!   The Dynamex ruling is now CA State law and will NOT be appealed.

5 Tips From Your Insurance Broker!

Here are 5 tips from The Insurance Mom about Health Insurance you know only if you have an insurance broker — Read On!

  1.  You can’t just get individual health insurance any old time.   Enroll only during Open Enrollment!  The next one is November for coverage starting January 1st.   If you have coverage at work, you have to wait until your employer’s open enrollment period.
  2. Pay your individual insurance bill within 30 days or you’ll lose the insurance (oh no!).   You’re out of luck until the next Open Enrollment.  In some states there are options, but none will protect you like regular health insurance.
  3. ONE free physical a year, with an IN-network doctor, is included in every policy.   Ladies, you get a gyno visit too.   No dollars out of your pocket.   Not even a copay!  Check with your insurance broker to find out which specific exams and lab tests are included.
  4. ALL FDA-approved birth control is FREE now if you want it!
  5. Kids are automatically enrolled in pediatric dental & vision coverage.  As long as you go to an IN-network dentist or optometrist, standard cleanings and exams are free and most costs will be discounted.

COBRA Subsidy Extention – again

On March 2, 2010, ARRA was amended by the Temporary Extension Act of 2010, which extending federal funding for the ARRA COBRA subsidy and unemployment benefits.

The deadline for eligibility for the 65% health insurance premium subsidy has now been extended through March 31, 2010. Previously, eligibility only extended to those who lost their jobs through Feb. 28.  Those eligible can still receive the subsidy for 15 months.

But watch out, this extension is even more complicated than the original subsidy eligibility rules.  Not everyone will qualify.   Make sure your employer or your insurance company gives you accurate information!

I wonder why they don’t just extend the subsidy through the end of the year.   Why dole it out one month at a time?  Oh, yeah… it’s the politicians at work, again.

COBRA Subsidy Extention DID happen!

Happy Merry HoHoHo!

The House and Senate have passed the legislation; Obama is expected to sign quickly.   This will help you in two ways:

The eligibility period has been extended to February 28, 2010.   Which means that if you become eligible for continuation of your group benefits under the COBRA laws, you will still have until 2/28/10 to take advantage of the Federal premium subsidy.

AND… if you’ve almost run through the original 9 months of subsidy, you’ll get another six months of help, for a total of 15 months.

COBRA Subsidy Extension Could Happen

This is good news for anyone who is currently enrolled in a group health insurance plan under the Federal COBRA or California Cal-COBRA laws.    The House of Representatives has approved a 6-month extension of the Federal subsidy to help you pay the premiums.   Now the bill — HR 3326 — is on its way to the Senate for approval, hopefully before the subsidy ends on 12/31/09.    To read more about it, go here.…
